Lease extension process

Most flats are sold on a leasehold basis, and as the time that is left on the lease reduces, the value of the flat can be affected.

With a leasehold property, although you own the property, you don't own the ground on which it stands, or, with a flat, the fabric of the building in which it is situated as these are owned by the freeholder of the property. The length of the lease reduces as the property ages.

Therefore it is common for owners of leasehold properties to seek a lease extension agreement with the owner of the freehold. This can be done by negotiation, or you may have to follow the statutory procedure. The law gives owners of leasehold properties certain rights to extend a lease under the Leasehold Reform Housing and Urban Development Act 1993, subject to owning the flat for two years.
